When it comes to DUI in the Tempe, Scottsdale, and Phoenix, AZ areas, it is highly likely that you will end up dealing with serious consequences should you engage in this highly dangerous activity. However, not all DUI cases are what they seem. In fact, what recently seemed like a clear cut DUI arrest ended up being something very different than what it was initially thought to be. Today, Mark Weingart of The Weingart Firm is blogging from his Tempe office to tell the story of Julie Cunningham and how a potential DUI arrest may have actually saved her life.
On July 31st, Julie Cunningham hit a curb and crashed into a fire hydrant shortly after dropping her kids off at daycare. When police arrived at the scene, Cunningham had no memory of what happened, though it is suspected that she lost consciousness on the road. She was then arrested under suspicion of DUI, as she was exhibiting signs such as slurred speech, and spent the night in jail before being picked up by her brother the next day.
Despite Cunningham showing signs of driving under the influence when spoken to, her breathalyzer exam came out as a 0.0. Police are still waiting on the results from her toxicology report but so far no charges have been filed, nor does it seem like any will. When Cunningham was released, her mom felt that the entire situation was out of character for her and took her into the hospital for examining. The results of this examination would stun the entire family.
Doctors at UT Southwestern found a lemon-sized tumor waiting for them on Cunningham’s brain. While it was said to be non-cancerous, it was heavily advised that the tumor be removed before it could cause any more problems. She was promptly brought into surgery and the tumor was removed, a procedure that Cunningham is currently recovering from. When asked, Julie Cunningham says that she has no recollection of the accident, nor does she even remember the police becoming involved or spending the night in jail.
