A DUI charge is levied against drivers whose blood alcohol content (BAC) is in excess of 0.08. For drivers under the age of 21, there is a zero tolerance policy with regard to BAC; commercial drivers cannot have a BAC in excess of 0.04.
In addition to the fines we’ll cover below, a combination of jail time, probation, license suspension, and enrollment in a drug/alcohol education program are all part of the penalties for DUI convictions.
The following fines are levied against those convicted of a DUI.
Those convicted of a first offense DUI will also be required to pay for the installation of an ignition interlock device in their vehicle.
The following fines are levied against those convicted of a second offense DUI (a second DUI arrest within seven years of the first).
As with first offense DUIs, those convicted of a second DUI will also be required to pay for the installation of an ignition interlock device.
A third offense DUI is a third DUI arrest within seven years of the previous convictions. This is considered a felony, and the legal penalties for this are severe. In addition to mandatory imprisonment and long-term license suspension, the convicted must pay the following fines.
As with previous DUI convictions, a third offense DUI will require the convicted to pay for the installation of an ignition interlock device.
Extreme DUI is any DUI arrest in which the driver’s BAC is 0.15 or greater. In these cases, penalties and fines are much greater given the nature of the offense.
