Right now, our legal team would like to discuss matters with regard to jail time and DUI arrests.
DUI arrests occur when a driver is stopped and is found to have a blood alcohol concentration (BAC) in excess of 0.08. For commercial drivers, the permitted BAC is 0.04. For drivers under the age of 21, there is zero tolerance with regard to BAC (i.e., no alcohol should be in the driver’s system).
Yes. In fact, jail time is a part of all DUI arrests. Obviously the amount of time will vary based on the nature of the offense, though even first-time DUI arrests will involve some form of incarceration in addition to various fines and other penalties.
For first-time DUI arrests, a person will spend a minimum of 24 hours in jail. In serious cases, a person may spend more time in jail, though the duration of the jail time cannot exceed 10 days.
Second-time DUI arrests refer to a second DUI charge within 7 years of the prior arrest. People arrested for a second DUI will need to spend a minimum of 30 days in jail. Additional jail time may be involved, but overall jail time for a second DUI arrest cannot exceed 90 days.
A third DUI arrest in a 7-year period is a third-offense DUI. In these cases, a person is required to spend at least 4 months in jail.
Extreme DUI refers to cases in which a person’s BAC is 0.15 or higher. Given the higher BAC, the offense is treated more seriously. First-time extreme DUI arrests will involve a minimum of 30 days in jail, with a maximum of 6 months; second-time DUI arrests will involve a minimum of 120 days in jail, with a maximum of 6 months.
